Subscribers who owe waste services will be limited in their payment for electricity
This is stipulated in the Law of the Republic of Uzbekistan No. 1044 dated March 7, 2025 “On Amendments and Amendments to Certain Legislative Acts of the Republic of Uzbekistan to Strengthen Payment Discipline in the Field of Waste Collection and Removal Services”. We previously reported that this Law was adopted by the Legislative Chamber on December 24, 2024 and approved by the Senate on February 21, 2025. As is known, in recent years, systematic work has been carried out in our country to improve the quality of waste collection and removal services and actively attract business entities to this sector. At the same time, the sharp increase in the population's receivables for waste collection and removal services makes it necessary to increase the level of payment discipline for these services. This Law introduces amendments and supplements to the Civil and Housing Codes of the Republic of Uzbekistan, the Laws “On Competition” and “On Electric Power”. According to it, legal norms aimed at temporarily restricting the receipt of payments for electricity from consumers who have debts for mandatory payments for solid waste collection and disposal services, after notifying them via short message (SMS), until this debt is eliminated, have been established. These are: — Article 468 of the Civil Code of the Republic of Uzbekistan: The sentence “An energy supply contract may also provide for other obligations in accordance with the legislation” has been added; — In Part 7 of Article 134 of the Housing Code of the Republic of Uzbekistan: “hereinafter referred to as water supply and wastewater disposal services” the words “services for the collection and removal of solid and liquid household waste” have been added; — Part 1 (paragraph 5) of Article 18 of the Law of the Republic of Uzbekistan No. 850 “On Competition” has been supplemented with the words “hereinafter referred to as provisions aimed at preventing consumer indebtedness for services for the collection and removal of solid household waste in accordance with legislative acts”; — Parts 1, 2 of Article 38, Part 5 of Article 39 and Part 3 of Article 40 of the Law of the Republic of Uzbekistan “On Electric Power” include the conditions for informing consumers who have debts for mandatory payments for solid waste collection and removal services via short message (SMS), temporarily restricting the receipt of payments for electricity from them for a period of five days from the date of sending the notification and until this debt is eliminated, and automatically canceling the restriction in case of elimination of the debt. In this case, enterprises providing solid waste collection and removal services are responsible for the reliability and accuracy of billing for services, and in case of violation of these requirements, the consumer is compensated for the damage caused. This Law serves to strengthen payment discipline for waste collection and disposal services provided to the population and reduce the population's receivables for these services. The Law shall enter into force 3 months after the date of its official publication.
